PURCHASE POLICY & RETURNS
1. General provisions
1.1 These Terms and Conditions of Purchase and Sale of Goods (hereinafter referred to as the “Rules”) set out the general conditions for using the Online Store www.holistico.lt (hereinafter referred to as the “Store”).
1.2 The goods specified in the store are sold to the Buyer by MB HOLISTICO, registered office address Algirdo str. 15-2B, 03219 Vilnius, legal entity code 305889866, (hereinafter referred to as the “Seller”).
1.3 These Rules are a legal document binding on the Buyer and the Seller and from the moment of the Buyer's order and payment become the contract of purchase and sale of the Goods concluded by the parties (hereinafter - the contract).
1.4 It is considered that the Buyer has read the rules after ordering the Goods.
1.5 The Seller reserves the right to change, amend or supplement the Rules in force at the time of placing the order.
2. Registration and processing of personal data
2.1 In order to use the Store and buy the goods offered in it, the Buyer adds the selected Goods to the Shopping Cart, presses the "BUY" button and confirms that he has read the rules and filled in personal data (name, surname or legal entity name and code, telephone number and e-mail). The postal address (if delivery by courier service is chosen) and, having chosen the delivery method, submit an order for further execution (perform the following actions related to the payment for the Goods, as specified in Clause 3.2 of the Rules).
2.2 The buyer is responsible for ensuring that the information provided at the time of ordering is accurate, correct and complete. If the data provided by the Buyer changes, he must immediately inform the Seller.
2.3 By submitting his data, the Buyer together grants the Seller the right to collect, store, systematize, use and process for the purposes provided for in these Rules all and any personal data provided by the Customer directly or indirectly when placing an order for Goods in the Store.
2.4 The personal data provided by the Buyer will be processed in accordance with the requirements established by the Law on the Legal Protection of Personal Data of the Republic of Lithuania, as well as other legal acts of the Republic of Lithuania regulating the processing and protection of such data.
2.5 The Buyer's personal data will be used for the sale and delivery of goods, issuance of accounting documents, return of overpayments and (or) money for the goods returned by the Buyer, fulfillment of other obligations arising from the contract of sale.
2.6 The personal data provided by the Buyer will be used exclusively by the Seller and its partners with whom the Seller cooperates in the delivery of the Goods and / or other services related to the submission or fulfillment of the Buyer's order.
2.7 The Seller may use for statistical purposes data not directly related to the Buyer's person, ie data on the purchased goods. Such statistics will be collected and processed in such a way as not to reveal the identity of the Buyer or other personally identifiable information.
2.8. The Buyer's personal data will be stored for no longer than required by the data processing purposes. When personal data are no longer needed for the purposes of their processing and / or the retention period expires, they will be destroyed.
3. Prices of goods, payment procedure
3.1. The Goods are sold to the Buyer at the prices valid in the Store at the time of placing the order.
3.2. The buyer pays for the goods using (optional):
3.2.1 by bank card, choosing the payment method by CARD;
3.2.2 with a bank card or funds in an Apple Pay account through the Apple Pay system by choosing the Apple Pay payment method.
4. Delivery of goods
4.1 The store trades and goods are delivered throughout Lithuania, except for the Curonian Spit.
4.2 The goods are delivered via DPD courier service or by physical collection in Vilnius.
4.3 The following fees apply for the delivery service:
4.3.1 via courier service - EUR 3.50
4.4 Delivery terms:
4.4.1 when delivering via courier service - within 2-4 days from the date of payment for the Goods;
4.5 If delivery of the goods is not possible due to the fault of the Buyer or due to circumstances beyond the Buyer's control, the goods will not be sent again (unless the Buyer pays extra for re-delivery of the goods) and the money paid in advance for the goods will be refunded.
4.6 The Buyer agrees that in exceptional cases the delivery of goods may be delayed due to unforeseen circumstances beyond the control of the Seller and / or courier service. In this case, the Seller undertakes to immediately contact the Buyer and coordinate the delivery of goods.
4.7 In all cases, the Seller shall be released from liability for violation of the terms of delivery of the goods, if the goods are not delivered to the Buyer or are not delivered on time due to the fault of the Buyer or due to circumstances beyond the Buyer's control.
4.8 During the delivery of the Goods, the Buyer must together with the courier representative check the condition of the consignment packaging and delivered Goods, without the Buyer's inspection of the consignment packaging and suitable.
5. Withdrawal from the contract. Exchange and return of goods
5.1 The Buyer has the right to withdraw from the contract of purchase and sale of goods concluded in the Store without giving reasons, notifying the Seller in writing no later than within 14 (fourteen) calendar days from the date of delivery or if the goods have not been delivered at the time of withdrawal. return form, which can be found on the Store's website, and by submitting it to the Seller by e-mail. by mail: ieva@holistico.lt
5.2 After submitting a written notice of withdrawal and filling in the return form, the Buyer must return the goods no later than within 14 (fourteen) calendar days (if delivered) by sending it to the Seller's registration address. The costs of returning/sending the goods shall be paid by the Buyer.
5.3 The Seller shall return to the Buyer all amounts paid by the Seller for the purchase and delivery of the Goods not later than within 14 (fourteen) calendar days. The Seller has the right not to return the amounts paid by the Buyer until the goods have been returned to the Seller or until the Buyer provides proof that the Goods have been sent to the Seller.
5.4 For the reasons specified in Clause 5.1 of the Rules, the returned Goods must be undamaged, have not lost their commercial appearance (the labels have not been removed and damaged, the protective films have not been torn off, etc.) and must not be used. The product must be returned in the original packaging, the same set as received by the Buyer, necessarily with the purchase and other documents of the product. If the product is not fully completed, is damaged, untidy or is not properly packaged, the Seller has the right not to accept the product, not to change it and not to return the money paid by the Buyer for the product.
5.5 The Buyer, having purchased the defective Goods and recording them in accordance with the procedure established in Clause 4.8 of the Rules, has the right to apply to the Seller with a request within 14 (fourteen) calendar days from the delivery/collection of the Goods:
5.5.1 replace with an analogous product of suitable quality;
5.5.2 reduce the purchase price of the Goods;
5.5.3 unilaterally terminate the Agreement and return the price of the Goods paid.
5.6. In the case specified in Clause 5.5.1 of the Rules, the Seller shall bear the costs of returning the Goods and delivery of similar goods.
5.7 In the case specified in Clause 5.5.3 of the Rules, the Seller shall refund the price of the Goods paid to the Buyer, including delivery costs, as well as cover the costs of returning the Goods to the Seller.
5.8. In all cases, the money is not returned to the Buyer for those Goods that were obviously intentionally or through negligence damaged by water, high temperature, sharp objects, etc. The Buyer did not detect and record the relevant violations in accordance with Clause 4.9.
5.9 If the Buyer is not delivered the Goods that he has ordered, the Buyer shall inform the Seller thereof within 3 (three) working days at the latest, and the Seller undertakes to replace them with suitable Goods at his own expense.
5.10 In case the Seller does not have the ordered Goods, he shall return the money paid for the Goods to the Buyer no later than within 14 (fourteen) calendar days from the date of ordering the Goods, informing the Buyer accordingly.
6. Exchange of information
6.1 The Seller shall send all notices and otherwise contact the Buyer provided by e-mail or telephone.

7. Final provisions
7.1 These Rules have been drawn up in accordance with the legal acts of the Republic of Lithuania, and the law of the Republic of Lithuania shall apply to the relations arising from them.
7.2 In the event of damage, the guilty party shall indemnify the other party for direct losses in accordance with the procedure and on the grounds established by the laws of the Republic of Lithuania.
7.3 All disagreements arising from the implementation of these Rules shall be resolved through negotiations. If no agreement is reached, disputes shall be settled in accordance with the laws of the Republic of Lithuania.
